Consumer Narrative

The company is attempting to collect an inaccurate and unverified rental debt based on charges that were incurred while my apartment was legally uninhabitable. After a hurricane, the unit suffered severe water intrusion, extensive mold growth on the ceiling, leaks, damaged drywall, exposed framing, and pest issues. Repairs were delayed for weeks and left incomplete, and I could not safely or normally live in the unit during this time. I repeatedly contacted the landlord to fix these issues, but the problems continued for months. I emailed, called the office, and even attempted to speak in person to resolve the situation. My communications were ignored or delayed, and the conditions were never fully restored. Photos and email records have been provided as evidence. Despite the unit being uninhabitable under Florida Statute 83.51, the landlord charged full rent without reduction and later sent an inflated balance to a debt collector. Under Florida Statute 83.56, charges that accrue during periods where the unit is unsafe or uninhabitable are not legally valid or enforceable. I formally requested documentation including : a full itemized ledger, move-out statement, repair invoices, proof of charges, original lease documents, and full debt validation. None of this required documentation was provided. The company did not show how the amount was calculated, did not provide any itemization of charges, did not provide repair records, and did not provide a legally compliant debt validation under FDCPA 809 ( b ). The collector is now reporting a balance that is materially inaccurate, unsupported, and unverifiable. Reporting or attempting to collect an unvalidated debt violates FDCPA 809 ( b ) and constitutes an incomplete or insufficient investigation under FCRA 611 ( a ). This debt can not be legally verified, and the amount being collected is wrong. The continued attempt to collect an incorrect amount, without documentation, and based on periods where the landlord failed to maintain habitability is causing material consumer harm, including negative credit reporting, financial stress, and difficulty obtaining housing and credit. I am requesting CFPB assistance to require the company to : ( 1 ) provide full validation with original documentation as required by law, or ( 2 ) remove the collection entirely if they can not validate the debt. Evidence of habitability issues, communications, and attempts to resolve the matter have been attached
