Midland Credit Management has been harassing me with repeated threats of a lawsuit during a phone call about XXXX accounts they claim to own. On XX/XX/year> at approximately XXXX XXXX, the representative told me multiple times that the company was planning to sue me, even though I have never received any written intent to sue, no pre-legal notice, and no court summons. These statements constitute false legal threats in violation of FDCPA 807 ( 5 ). When I attempted to negotiate a settlement, the representative continued using verbal threats of legal action to pressure me into paying a higher amount immediately. The tone of the call was intimidating, coercive, and abusive. I felt extremely scared and uncomfortable due to these aggressive tactics. Additionally, the balances and reporting dates Midland is furnishing to the credit bureaus do not match the original creditors information. XXXX charge-off letter lists a balance of {$1800.00}, while Midland reports a different balance of {$1700.00}. The dates of delinquency, charge-off, and other account details also do not match. This violates the FCRA ( 15 U.S.C. 1681e ( b ) ), which requires debt collectors to report accurate and verifiable information. Midland also failed to provide full validation of the alleged debts under the FDCPA.
