XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXXXXXX NJ XXXX XXXX XXXXXXXX XXXX Consumer Financial Protection Bureau XXXX XXXX XXXX XXXX XXXXXXXX, Iowa XXXX RE : Follow-up Complaint & Allegation of Retaliation Against Credit Acceptance Original CFPB Complaint Number : XXXX Loan Account Number : XXXX Your Vehicle Information : XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX Dear CFPB Analyst, I am writing to file a follow-up complaint and to report a serious act of retaliation by Credit Acceptance Corporation following my previous CFPB complaint , filed on or about XX/XX/XXXXXXXX 1. Background : Original Complaint ( Breach of Contract ) My initial complaint, referenced above, concerned Credit Acceptance 's breach of contract by charging me fees for property taxes on an all-electric vehicle. In my state, all-electric vehicles are exempt from such taxes. After the CFPB contacted them, Credit Acceptance provided a partial reimbursement of {$1300.00}, which did not cover the full amount of the illegally assessed fees. The remaining disputed balance is {$1100.00}. 2. The Retaliatory Action Subsequent to my CFPB complaint, and directly in response to it, Credit Acceptance has engaged in a retaliatory action that has caused me significant new harm and financial burden. On or around [ Date you discovered the repo status ], I discovered that Credit Acceptance had placed my account into an " international repo status '' or a similar heightened repossession status. This action was taken despite me being in good standing on my payment plan, with no defaults or late payments that would justify such a severe measure. This retaliatory " repo status '' has created an immediate and severe financial burden in the following ways : It has placed my vehicle at imminent risk of wrongful repossession. It has likely severely damaged my credit score. It has caused me significant stress and XXXX, fearing the loss of my primary vehicle for work and family needs without justification. 3. Violations and Request for Relief I believe Credit Acceptance 's actions constitute a violation of the Consumer Financial Protection Act, which prohibits unfair, deceptive, or abusive acts or practices ( UDAAP ). Retaliating against a consumer for exercising their right to file a complaint with a government agency is both unfair and abusive. To resolve this matter, I demand that Credit Acceptance : 1. Immediately and Permanently Remove the " international repo status '' or any repossession order from my account. 2. Provide written confirmation that my account is in good standing and that no repossession activity is authorized. 3. Fully reimburse the remaining balance of the illegally assessed tax fees, totaling {$36000.00} 4. Compensate me for the damages caused by their retaliation, including for the negative impact on my credit and the severe emotional distress. Attached Documentation : For your review, I have attached the following : A copy of my previous CFPB complaint confirmation. Correspondence from Credit Acceptance regarding the partial fee reimbursement. Any statements or online account screenshots showing the account status or the remaining fee balance. Asking credit Acceptance to furnish original contract with my wet signature to validate this contract and Any communication or evidence I have regarding the repossession status.
