Consumer Narrative

I am filing this complaint regarding false late-payment entries reported on my credit file. The creditor/furnisher has inaccurately reported late payments that never occurred, and despite multiple disputes, these entries remain uncorrected. The credit reporting agencies ( CRAs ) and furnishers have failed to conduct a reasonable investigation or to ensure that my credit information is accurate, in violation of federal law. Violations of Federal Law 1. Fair Credit Billing Act 15 U.S.C. 1666b This statute governs the timing and crediting of payments. Creditors are required to accurately report payment dates and histories. By reporting late payments that did not occur, the creditor violated this provision and misrepresented my account history. 2. Gramm-Leach-Bliley Act 15 U.S.C. 6802 This law restricts the sharing of nonpublic personal information. Reporting false or misleading late-payment information to third-party credit bureaus constitutes an unauthorized disclosure of inaccurate personal data, in violation of this statute. XXXX. Fair Credit Reporting Act 15 U.S.C. 1681a ( i ) ( 1 ) ( A ) The FCRA requires that only accurate and verifiable information be included in consumer credit reports. Continuing to publish false late-payment data after I disputed it violates this accuracy standard. 4. FCRA 15 U.S.C. 1681s-2 Furnishers have a duty to report information accurately and to correct errors upon notice. The furnisher in this case failed to conduct a reasonable investigation or correct the misreported payment history, despite my repeated disputes. 5. FCRA 15 U.S.C. 1681i and 1681e ( b ) The CRAs are required to reinvestigate disputed information and maintain reasonable procedures to ensure maximum possible accuracy. Their continued reporting of inaccurate payment history demonstrates noncompliance with these provisions. XXXX. Legal Precedent In XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX ), the court held that credit reporting agencies must conduct an independent investigation when a consumer disputes information. They can not merely rely on the furnishers verification. The continued reporting of these false late-payment entries without independent verification mirrors the wrongful practices identified in XXXX and constitutes a clear violation of the FCRA.
