Consumer Narrative

This complaint is a Method of Verification ( MOV ) request directed to LexisNexis Risk Solutions regarding a XXXX XXXX bankruptcy LexisNexis is reporting in my consumer file and providing to the nationwide credit bureaus. LexisNexis is reporting a XXXX XXXX bankruptcy under my name. I previously disputed this item directly with LexisNexis. In response, LexisNexis stated that it verified the bankruptcy using PACER and by matching my personal identifiers ( address and last four digits of SSN ) with what the nationwide credit bureaus have on file. The response focused on opt-out information and did not provide a meaningful description of the procedures used to verify the bankruptcy, nor did it clearly identify any lawful furnisher of the information. Through this CFPB complaint, I am submitting a focused MOV request and asking LexisNexis to answer the following, in writing, point by point : 1. Identify the actual source or furnisher of the bankruptcy information that LexisNexis relies on, including the full business name, mailing address, and telephone number ( for example, any court, court clerk, or third-party vendor that furnished this record to LexisNexis ) . 2. State clearly whether LexisNexis obtained this bankruptcy directly from a court or indirectly through any third-party data vendor, aggregator, or intermediary. If any vendor or intermediary was used, identify that entity by full name, address, and phone number. 3. Provide a detailed description of the procedures LexisNexis used when it claims it verified this bankruptcy after my dispute, including : What databases or systems were accessed ; What specific information was compared ( for example, only name/SSN/address, or the underlying court docket entries themselves ) ; How the verification was documented internally ; and What criteria LexisNexis used to conclude that the bankruptcy is accurately associated with me. 4. Explain whether LexisNexis received or relied on any independent verification from a lawful furnisher ( such as a court clerk or an entity that formally furnishes public-record data to LexisNexis ), beyond simply viewing my information in PACER and matching identifiers. 5. If LexisNexis can not identify and document a lawful furnisher and a complete verification procedure for this bankruptcy that satisfies its obligations under the Fair Credit Reporting Act, I am requesting that LexisNexis delete this bankruptcy from my LexisNexis file and notify any downstream consumer reporting agencies that received this record from them so it can be corrected or removed. This is a targeted MOV request. I am asking LexisNexis to directly address each of the numbered items above instead of sending a generic form response or repeating prior language.
