Consumer Narrative
I am filing this complaint regarding the inaccurate and unlawful reporting of an alleged debt by XXXX, listing XXXX XXXX as the original creditor. The account, allegedly opened XX/XX/year>, for {$1400.00}, has been reported to the credit bureaus without any written validation, contract, or lawful verification of ownership. Under the Fair Debt Collection Practices Act ( FDCPA, 15 U.S.C. 1692g ), I am entitled to receive written validation of any alleged debt before collection or reporting. XXXX has failed to provide : The original contract bearing my signature ; A complete itemized accounting showing how the balance was calculated ; and Proof of assignment or ownership confirming MRCIs legal authority to collect. Additionally, the Fair Credit Reporting Act ( FCRA, 15 U.S.C. 1681e ( b ), 1681s-2 ( a ), and 1681i ( a ) ( 5 ) ) prohibits furnishers from reporting inaccurate or unverifiable data and requires credit reporting agencies to ensure maximum possible accuracy. Reporting this unverifiable debt violates those obligations. Further, under the Truth in Lending Act ( TILA, 15 U.S.C. 1666b ), no payment may be considered or reported late without at least 21 days billing noticenone was ever provided. By continuing to report this debt without validation, XXXX and XXXX have committed multiple violations of federal law. I request immediate deletion of this account from all credit bureaus and written confirmation of compliance within 15 days. If validation can not be produced, XXXX must cease all collection activity and instruct XXXX XXXX XXXX XXXX to permanently remove this item under FCRA 1681i ( a ) ( 5 ) ( A ).
