Date of Incident : XX/XX/XXXX Case Number : XXXX Summary of Complaint : On XX/XX/XXXX, my ex-husbands attorney initiated a garnishment against my bank accounts in connection with the above-referenced case. I was not properly notified of the garnishment by Wells Fargo. I only became aware of the issue when my debit card transactionsincluding my rent paymentwere declined. Upon investigation, I discovered the garnishment documentation on the XXXX XXXX XXXX website. I promptly filed the Defendants Claim Form with the court. A hearing was scheduled for XX/XX/XXXX. However, on XX/XX/XXXX, an automatic stay was placed on the case, and the hearing was canceled. According to the garnishment order, Wells Fargo was instructed to hold all money, wages, property, etc. for the next 5 days and then send the property, money, as above, to the court concurrent with the answer. Instead of complying with this directive, Wells Fargo released the funds to the opposing counsel, XXXX XXXX, rather than sending the money to the court as required. When I contacted Wells Fargo, I was told the funds had been sent to XXXX XXXX account, and that I needed to contact her to recover the money. This appears to be a clear procedural violation and mishandling of garnished funds by Wells Fargo. The bank failed to : Provide timely notification of the garnishment, depriving me of the opportunity to respond before my funds were frozen. Hold the funds for the required XXXX days per the court order. Send the garnished funds to the court as required by Georgia law and the orders explicit instructions. This mismanagement directly impacted my ability to pay rent and other essential expenses for myself and my XXXX son. Requested Resolution : I request the FDIC to investigate XXXX XXXX actions regarding this garnishment, including : Whether the bank complied with federal and state garnishment procedures ; Why the funds were transferred directly to the opposing attorney instead of the court ; Why notice of the garnishment was not timely provided to me ; and How Wells Fargo will remedy this error, including the return of my funds.
