Consumer Narrative
This submission serves as a formal dispute under the Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681 et seq., regarding an inaccurately reported charged-off account that continues to appear on my credit reports. The ongoing reporting of both the Charge-Off status and repeated Late Payment notations violates federal law and has caused serious and unjust harm to my credit reputation and financial standing. ACCOUNT DETAILS Creditor/Furnisher Name : Equifax : XXXX XXXX XXXX XXXX : XXXX XXXX XXXX XXXX Account Number : XXXX Date of First Delinquency : XX/XX/XXXX Type of Error / Basis for Dispute : Incorrect payment history Incorrect status listed as Charge Off I do not recognize the charge-off status, late-payment notations, or any balance write-off LEGAL BASIS FOR DISPUTE Under FCRA 1681e ( b ), consumer reporting agencies must maintain maximum possible accuracy in the information they report. If any portion of this account data is inaccurate, outdated, or unverifiable, it must be corrected or deleted immediately. Under FCRA 1681i ( a ), once a consumer dispute is received, a credit reporting agency must conduct a reasonable reinvestigation and must obtain verified documentation from the original furnisher, not rely solely on automate d systems such as e-OSCAR. In Cushman v. TransUnion Corp., 115 F.3d 220 ( 3d Cir. 1997 ), the court ruled that CRAs have a non-delegable duty to perform a reasonable investigation and can not simply defer to the furnishers unverified confirmation. Failure to do so constitutes negligent or willful noncompliance under 15 U.S.C. 1681n and 1681o. WHY THE REPORTING IS INACCURATE The Charge Off designation and the accompanying Late Payment history are inconsistent with the accounts actual history and remain unsupported by verified documentation. Despite prior disputes, none of the credit bureaus have provided the original records or verification supporting this derogatory information. Continuing to report unverifiable or inaccurate negative data violates FCRA 1681e ( b ) and 1681i ( a ). HARM The ongoing reporting of these inaccurate derogatory remarks both the Charge Off and Late Payment entries has : Lowered my credit scores substantially Increased my cost of credit and insurance Limited access to housing and employment opportunities Caused ongoing reputational and financial damag e REQUESTED ACTIONS UNDER FCRA 611 Immediate removal of all derogatory reporting. Delete the Charge Off status and all Late Payment notations from my credit files with all CRAs. If these entries can not be verified as accurate and complete, they must be permanently deleted pursuant to FCRA 611 ( a ) ( 5 ) ( A ). Provide full reinvestigation details. Supply a complete written summary of the reinvestigation, including the procedures used, verification sources, and start/end dates, per FCRA 611 ( a ) ( 6 ). Provide documentation or written confirmation. Send written confirmation that the Charge Off and all Late Payment entries have been permanently deleted or, if you choose to retain them, provide detailed documentation from the furnisher relied upon for verification, including the furnishers name, address, phone number, and method of verification ( FCRA 611 ( a ) ( 6 ) ( B ) ( iii ), 611 ( a ) ( 7 ) ). Updated report & description of procedures. Issue an updated copy of my credit report reflecting all corrections and include a full description of the reinvestigation procedures. The accounts age and positive history should remain intact, but all derogatory remarks must be removed if they can not be verified. Note : This complaint is being filed with the Consumer Financial Protection Bureau ( CFPB ), and the assigned Complaint Number will be referenced in all subsequent dispute communications with XXXX, Equifax, and XXXX to ensure transparency and compliance with the FCRA.
