Repeated Re-Reporting of Disputed and Removed Identity Theft Accounts Violation of FCRA and FDCPA I am filing this complaint because certain accounts that were previously disputed, investigated, and deleted from my credit reports by both the original creditor and prior collection agencies have reappeared under new furnishers. These new furnishers are now reporting the same fraudulent accounts, despite the fact that I have already : 1. Filed an FTC Identity Theft Report and provided supporting documentation, 2. Submitted police and fraud affidavits, and 3. Received prior deletions from the original creditor and prior collectors confirming that the accounts were fraudulent. This repeated re-reporting of deleted and disputed accounts constitutes a knowing and willful violation of federal law, specifically : 15 U.S.C. 1681s-2 ( a ) ( 1 ) ( A ) Furnishers of information shall not report information known to be inaccurate. 15 U.S.C. 1681s-2 ( a ) ( 1 ) ( B ) Prohibits reporting information after notice of dispute without proper verification. 15 U.S.C. 1681s-2 ( a ) ( 3 ) Requires furnishers to report the fact that a debt is disputed. 15 U.S.C. 1681c ( a ) ( 4 ) & ( 5 ) Prohibits re-reporting of obsolete or previously deleted accounts. 15 U.S.C. 1681i ( a ) ( 5 ) ( A ) Mandates permanent deletion of inaccurate or unverifiable information after dispute. 15 U.S.C. 1692e ( 8 ) ( FDCPA ) Prohibits a collector from communicating credit information that is known to be false, including failure to communicate that a debt is disputed. This constitutes a reckless disregard for my rights under the FCRA and FDCPA. I am requesting that the Consumer Financial Protection Bureau ( CFPB ) initiate immediate investigation and instruct the credit reporting agencies and the current furnishers to : 1. Delete these accounts within four ( 4 ) business days, pursuant to my established identity theft claim and prior deletions, 2. Provide written confirmation of deletion, and 3. Cease and desist from any further reporting or re-reporting of these fraudulent accounts. Failure to comply may subject the furnishers and bureaus to statutory damages of up to {$1000.00} per violation under 15 U.S.C. 1681n and 1681o, in addition to punitive and actual damages as applicable.
