Consumer Narrative

On XX/XX/year>, I submitted a written dispute to Equifax that included my FTC Identity Theft Report and supporting documentation, pursuant to my rights under the Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681 et seq. In my dispute, I identified several collection accounts that do not belong to me and provided documentation establishing that these accounts were the result of identity theft. I requested that Equifax block and delete the fraudulent accounts in accordance with 15 U.S.C. 1681c-2 ( Section 605B ) of the FCRA. Equifax later mailed me a response acknowledging receipt of my dispute and confirming that the identified collection accounts would be deleted. However, as of today, Equifax has not updated my credit report to reflect these deletions. The fraudulent and inaccurate collection accounts are still being reported, which continues to negatively impact my credit profile. Under Section 605B of the FCRA, a consumer reporting agency must block identity theft-related information from a consumers file within XXXX business days of receiving an identity theft report and sufficient proof of identity. XXXX failure to remove this information within the legally required timeframe constitutes a violation of 15 U.S.C. 1681c-2. Additionally, by continuing to report inaccurate information, Equifax is also violating 15 U.S.C. 1681e ( b ), which requires credit reporting agencies to maintain maximum possible accuracy of the information they report.
