Consumer Narrative
I am filing this complaint against Target for inaccurate and misleading credit reporting in violation of the Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681s-2 ( a ). My Target account was charged off and transferred to collections in XX/XX/year>. Since that date, XXXX XXXX XXXX, a third-party collection agency, has been contacting me in writing to collect the balance. This indicates Target no longer maintains ownership of the debt. However, despite this transfer, Target continues to report the account as charged off with an open balance to all three major credit bureaus ( XXXX XXXX and XXXX ) and continues to update the account monthly. This creates the false impression that I currently owe Target a balance and that the account remains active, which is factually incorrect. Details of the Issue - Original Creditor : Target Account number : XXXX - Collection Agency : First Source Advantage - Date Transferred to Collections : XX/XX/year> - Credit Bureaus Affected : XXXX, XXXX, and XXXX - Type of Inaccuracy : - Reporting a balance after charge-off and transfer - Continuing monthly updates post-transfer - Double reporting of the same debt by both Target and the collection agency This double reporting is damaging to my credit score and misrepresents my financial liability. Under the FCRA, furnishers of credit data are required to provide accurate and complete information and must promptly correct any errors once identified. Applicable Law Under FCRA 623 ( a ) ( 1 ) ( A ), a furnisher may not report information to a consumer reporting agency if it knows or has reasonable cause to believe that the information is inaccurate. Additionally, 623 ( a ) ( 2 ) requires furnishers to promptly update and correct information that is determined to be incomplete or inaccurate. Targets continued reporting of a charged-off account with an open balance after transfer to collections violates these provisions.
