Debt collector File # : XXXX Re : Request for Debt Validation or 1099-C and Cease and Desist Notice Account : XXXX Ending XXXX To Whom It May Concern, I am writing regarding my XXXX account ending XXXX, which was charged off on XX/XX/XXXX and subsequently sold to Zwicker & Associates XXXX XXXX file # XXXX, for collection. Per my previous dispute with the CFPB on XX/XX/XXXX, I requested debt validation for this account. XXXX responded on XX/XX/XXXX by providing 203 pages of billing statements but also issued a written statement confirming that they can not provide my signature or original application to validate the account. In their own words, this confirms that the debt can not be verified under 15 U.S.C. 1681i, which clearly states that if a creditor can not provide a consumer with a signature or application, the debt is unverifiable and must be deleted. I have since received correspondence from Zwicker & Associates XXXX, indicating that XXXX has allegedly sold or transferred this debt without my consent. I have no signed contract or agreement with either XXXX or Zwicker & Associates XXXX. establishing that I am legally obligated to pay this alleged debt. Accordingly, I am formally requesting the following : 1. A 1099-C form supporting the charge-off, or XXXX. Proper debt validation, including a signed contract with my wet signature showing my agreement to pay Zwicker & Associates XXXX. for this XXXX account. The letters previously provided by both XXXX and Zwicker & Associates XXXX. do not constitute lawful debt validation. Without proper documentation, continued collection activity or credit reporting of this account is inaccurate and in violation of the Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681e ( b ) and 1681i, as well as the Fair Debt Collection Practices Act ( FDCPA ), 15 U.S.C. 1692g ( b ). Cease and Desist Notice : Under 15 U.S.C. 1692c ( c ) of the FDCPA, I am hereby requesting that Zwicker & Associates XXXX. cease all communication with me immediately, except to provide : The legally required debt validation documents, or Written notification that collection efforts have been terminated or that the account has been returned to the original creditor. If neither a 1099-C nor proper debt validation can be provided, I request that this account be deleted from all credit reporting agencies immediately. Continued collection or reporting of this unverifiable account will be reported to my State Attorney Generals Office for further review. I am also attaching copies of all correspondence and documentation received from both XXXX and Zwicker & Associates XXXX. as proof of my prior requests and to support this formal complaint.
