i filed a complaint with your agency and im not happy with the results from the investigation in complaint # ( XXXX ) original complaint : ( SS # XXXX birthday XX/XX/year> This CFPB complaint has been filled to request pursuant to FCRA 605B ( 15 U.S.C. 1681c-2 ) that you, the XXXX XXXX XXXX Equifax, and XXXX credit reporting agency , block information appearing on my consumer credit report that is the result of identity theft and fraud within XXXX business days of you receiving this complaint. This fraudulent inaccurate, and false information consist XXXX loans ( XXXX XXXX ) these are not mine.i have copies of the consumer XXXX credit report maintained by you which shows these items I've mentioned.i do not recognize the aforementioned accounts, collections, or hard inquiries on my consumer report maintained by you.said accounts were not opened, made, or initiated by me. all these accounts I've mentioned are a result of fraud and identity theft. I have attached a copy of FTC Identity Theft Criminal Complaint # ( XXXX ) as proof from the XXXX Federal Trade Commission that all of the aforementioned consumer credit accounts, collections, and hard inquiries are the results of identity theft and fraud ) I am not happy with the results and i demand a reinvestigation and please give me details of how you verified and the names and adresss of those that verified this If the Bureau has verified that identity theft occurred, then : XXXX. You have acknowledged a crime under 18 U.S.C. 1028 ( Fraud and Related Activity in Connection with Identification Documents ), XXXX. The creditor ( s ) and credit reporting agency ( ies ) are under statutory duty to block or delete the fraudulent data, per 15 U.S.C. 1681c-2 ( a ) ( Fair Credit Reporting Act ), and XXXX. Any further furnishing or publication of that data constitutes willful noncompliance and defamation of credit, actionable under 15 U.S.C. 1681n and 1681o. Accordingly, I am demanding : A written explanation of how identity theft can be verified yet still remain on my file. The names and titles of any individuals or agencies who verified the theft. Immediate removal of all entries associated with the identity theft, including all tradelines, inquiries, and derivative accounts. A full reinvestigation pursuant to 15 U.S.C. 1681i ( a ), to include verification from the original data furnisher with certified proof of authorization or signature. Failure to comply will constitute continued negligence and bad-faith handling of a verified identity theft matter and may result in civil action for statutory, actual, and punitive damages.
