Consumer Narrative
I am filing this complaint because the credit reporting agencies have failed to properly investigate and delete unverified accounts from my credit report, in violation of the Fair Credit Reporting Act. In XX/XX/XXXX, I mailed a notarized dispute letter identifying multiple accounts as inaccurate, incomplete, and unverified. It has been over 45 days and instead of a proper reinvestigation, I received stall letters stating the accounts were verified. No explanation or documentation was provided as to how this verification was made. I do not believe there was a real investigation, as disputes are processed by automated systems within seconds, which is impossible under the FCRA requirements for reinvestigation. I specifically requested the method of verification under 15 U.S.C. 1681i ( a ) ( 7 ), which requires a consumer reporting agency to provide a description of the procedure used to determine accuracy, including the business name, address, and telephone number of any furnisher contacted. This has not been provided. The agencies have also failed under 15 U.S.C. 1681e ( b ) to ensure maximum possible accuracy in reporting. This conduct shows willful and negligent noncompliance with the law under 15 U.S.C. 1681n and 1681o. My first dispute was filed in XX/XX/XXXX, and these same unverified items are still being reported nearly a year later. Instead of correcting or deleting inaccurate information, the CRAs continue to recycle stall letters, leaving my credit file with false and damaging information. I have kept a paper trail for legal purposes, and I am attaching my dispute letters and a True Bill for damages. In light of recent lawsuits where XXXX and XXXX were found in violation of the FCRA for failing to ensure report accuracy, I am demanding immediate corrective action. I request the deletion of all unverified and inaccurate accounts, a proper reinvestigation with real documentation, and full compliance with the FCRA. If this continues, I will pursue legal remedies. The items below should all be removed from my consumer report under 15 US Code 1681i ( 6 ) as it has been over 45 days and you failed to comply.
