The Colony at XXXX XXXX in XXXX, Florida, has submitted a wrongful collection claim with Fair Collections & Outsourcing ( XXXX ) against me. Originally, they charged me an additional month of rent ( {$1500.00} ), however this charged was dropped after proving I had submitted my notice to vacate in adequate time. After making an administrative error about my move-out date, they failed to send a notice to impose claim of my security deposit ( {$250.00} ) with-in 30 days of move out according to Florida XXXX XXXX ( XXXX XXXX ( a ). My agreed move out date was XX/XX/year> and the notice was not posted until XX/XX/year>. The charges include a cleaning fee of {$30.00} for not cleaning the oven, which I accept. As well as a {$940.00} charge for carpet replacement. However, the carpet was not damaged and instead simply dirty in a high traffic area. According to Florida XXXX XXXX ( XXXX ) ( a ), landlords may not charge tenets for normal wear and tear to a carpet in high traffic areas. So, even if the notice to impose claim on my security deposit was sent on time, I should not be paying for a carpet replacement on a dirty carpet. With the extra month of rent & late fee ( {$140.00} ) being dropped, I currently owe {$710.00} to XXXX and the XXXX at XXXX XXXX in XXXX is still holding on to my security deposit of {$250.00}.
