Consumer Narrative
Complaint Update XXXX XXXX XXXX ( Alleged repossession account {$11000.00} ) I am submitting this follow-up regarding my complaint against XXXX XXXX XXXX for XXXX alleged repossession account in the amount of {$11000.00}. Summary of facts : XXXX responded to my original complaint with only vague, generalized statements and a promise that they will provide documentation. They have not produced any of the specific records I requested. XXXX has not produced a signed contract bearing my signature, itemized accounting showing how the {$11000.00} was calculated ( including repossession sale price, fees, credits/payments applied, and deficiency calculation ), proof of chain of title/assignment ( bill of sale ), proof of a deficiency notice and proof of mailing, or any verifiable proof that XXXX is licensed to XXXX in my state. XXXX continues to report this allegedly disputed account to the credit reporting agencies despite failing to validate the debt or provide any meaningful documentation. Legal bases for complaint statutes XXXX has violated : 1. FDCPA 15 U.S.C. 1692g ( b ) : XXXX failed to provide meaningful validation of the debt after my dispute, yet continued collection and reporting activity. A generalized response or a promise to send documents does not satisfy the validation requirement. 2. FDCPA 15 U.S.C. 1692e ( false, deceptive, or misleading representations ) and 1692f ( unfair practices ) : Reporting and attempting to collect an unvalidated/unsubstantiated debt is misleading and an unfair practice. 3. FCRA 15 U.S.C. 1681s-2 ( responsibilities of furnishers ) : As a furnisher of information to nationwide consumer reporting agencies, XXXX is XXXX to provide accurate information and to investigate and report results of consumer disputes to the CRAs. XXXX vague response and continued reporting demonstrate noncompliance with its duties as a furnisher. XXXX. FCRA 15 U.S.C. 1681i ( procedures on dispute ; reinvestigation ) : XXXX failed to correct or delete inaccurate information and has not provided the necessary documentation to substantiate the account ; the reinvestigation obligations are therefore not satisfied. XXXX. FCRA 15 U.S.C. 1681e ( b ) ( maximum possible accuracy ) : XXXX continued reporting of an unverified, unitemized alleged debt is inconsistent with the requirement to ensure maximum possible accuracy of furnished information. XXXX. Civil Remedies : If proven, these violations expose XXXX to statutory and actual damages under FCRA ( 15 U.S.C. 1681n, 1681o ) and FDCPA ( 15 U.S.C. 1692k ), including attorneys fees and costs. XXXX requested : Because XXXX has not provided legally sufficient validation, I demand the following immediate actions : XXXX. Cease all reporting and collection activity related to this account effective immediately. XXXX. Delete this tradeline from all consumer reporting agencies until and unless XXXX produces full, verifiable documentation. XXXX. Provide within 15 days of this submission : A copy of the signed contract with my signature ( if any ), A full itemized accounting showing each charge/fee, payments, repossession sale price, and the precise calculation that results in the {$11000.00} balance, A copy of the deficiency notice and proof of mailing, A bill of sale or assignment establishing chain of title from the original creditor ( Exeter ) XXXX XXXX, and any documentation showing XXXX license/registration to collect in my state. XXXX. Provide written confirmation to me and written notification to all three nationwide CRAs that this tradeline has been deleted or placed in a permanent do not re-report status until validation is provided. XXXX. Preserve all records and communications related to this account and all internal notes, sale/assignment documents, and vendor/third-party communications regarding the alleged debt. Notice of further action : If XXXX fails to comply with the above demands within 15 days, I will pursue all available remedies, including but not limited to : Filing additional complaints with the CFPB, the Federal Trade Commission, and the Georgia Attorney Generals office ; Initiating civil action seeking actual damages, statutory damages, punitive damages ( where available ), injunctive relief, and attorneys fees under the FCRA and FDCPA ; and Notifying the credit reporting agencies of XXXX continued failure to validate and requesting removal under FCRA procedures. I request the CFPB investigate XXXX practices with respect to my complaint and compel XXXX to produce the requested documentation or order deletion of the account. Thank you for your attention to this matter. XXXX XXXX XXXX
