Complaint Against XXXX XXXX XXXX XXXX XXXX XXXX XXXX ( Fraudulent Account ) I am filing this complaint against XXXX XXXX XXXX regarding a fraudulent XXXX XXXX XXXX XXXX account that they continue to pursue against me, despite being fully informed that I am a victim of identity theft and financial abuse. I was in an abusive relationship where my ex-boyfriend coerced and used my personal information and credit without my consent. This includes the XXXX XXXX XXXX XXXX account that XXXX XXXX XXXX is now attempting to collect from me. I did not open this account, authorize its use, or benefit from it in any way. I have submitted a formal police report documenting the fraud and abuse. In addition, I have recorded phone calls with XXXX XXXX XXXX where I repeatedly reported that the account was fraudulent and tied to my abusive ex. I have also submitted written documentation via certified mail directly to XXXX XXXX XXXX, which they received and ignored. Despite all of this, XXXX XXXX has refused to acknowledge or resolve the fraud. Instead, they have : Continued to report the account on my credit report, damaging my credit standing and preventing me from rebuilding financially. Threatened legal action/suit against me, despite having documentation that I am the victim, not the responsible party. Dismissed or ignored the police report, certified documentation, and the clear evidence I provided. Failed to conduct a proper investigation as required under the Fair Credit Reporting Act ( FCRA ) and Fair Debt Collection Practices Act ( FDCPA ). Specific Violations : FCRA 1681s-2 ( b ) : XXXX XXXX XXXX XXXX conduct a reasonable investigation after being notified of the dispute by the credit reporting agencies and provided with a police report. FCRA 1681c-2 ( Identity Theft Block ) : XXXX XXXX XXXX my request to block fraudulent information on my credit file after receiving an identity theft report. FDCPA 1692d : Engaging in conduct with the natural consequence of harassing, oppressing, or abusing me by continuing to collect after notice of fraud. FDCPA 1692e ( 2 ) ( A ) : Misrepresenting the character, amount, or legal status of the debt by treating a fraudulent account as if I were responsible. FDCPA 1692f : Using unfair or unconscionable means to attempt to collect a debt, including continuing collection despite clear evidence of fraud.
