Consumer Narrative

Complaint Against : Santander Consumer USA , Inc. Summary of Issue : I am filing this complaint regarding predatory and deceptive auto loan practices by Santander Consumer USA in connection with a XXXX vehicle purchase financed through a XXXX dealership in Virginia. Details of the Complaint : In XXXX, I entered a XXXX dealership with a XXXX XXXXXXXX Auto pre-approval and had already completed the required paperwork. Due to a temporary credit freeze, the dealership representative falsely informed me that I was denied financing, rather than advising me to lift the freeze. The dealership then steered me into a Santander loan, which doubled my expected monthly payment. I was assured I could refinance after six months at a lower rate, but the astronomically high interest rate charged by Santander made refinancing impossible. During COVID, Santander placed my account on relief, but instead of truly helping, they continued to capitalize interest and inflate my balance, worsening my financial position. Ultimately, my car was repossessed, and the loan now shows as a profit loss/charge-off on my credit report. Relation to XXXX Multistate Settlement : This case mirrors the predatory practices cited in the XXXX Multistate Settlement on Subprime Auto Loans, in which Santander agreed to provide more than {$550.00} XXXX in consumer relief. That settlement covered auto loans between XXXX and included Virginia consumers. My loan falls directly within that timeframe and demonstrates the exact same abusive behaviors described in the settlement : Targeting subprime consumers with unaffordable, high-risk loans, Failure to monitor dealerships who misrepresented consumer eligibility, Trapping consumers in loans they could not reasonably repay, Repossessions and charge-offs resulting from these practices.
