Consumer Narrative

CFPB Complaint Letter Consumer : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, TX XXXX Subject : Complaint Against XXXX, XXXX, and TransUnion for Reporting Paid and Obsolete XXXX XXXX XXXX Accounts What Happened I am filing this complaint because XXXX, XXXX, and TransUnion continue to report two XXXX XXXX XXXX accounts that are : More than 7 years old ( opened in XXXX and XXXX ). Paid in full to {$0.00} balances. Despite being paid to {$0.00}, these accounts are still reporting with balances and derogatory charge-off statuses. This is factually inaccurate reporting and violates the Fair Credit Reporting Act ( FCRA ). Additionally, all three bureaus have failed to list the Date of First Delinquency ( DOFD ), which is required to determine the 7-year reporting period. Violations of Law FCRA 605 ( a ) ( 4 ) [ 15 U.S.C. 1681c ( a ) ( 4 ) ] Negative accounts can not be reported more than 7 years from DOFD. Both accounts exceed this timeframe. FCRA 623 ( a ) ( 5 ) ( A ) Furnishers must report the DOFD on charged-off accounts. XXXX XXXX did not provide this. FCRA 607 ( b ) Bureaus must ensure maximum possible accuracy. Reporting balances on accounts already paid to {$0.00} violates this duty. FCRA 611 ( a ) ( 1 ) ( A ) Bureaus must conduct a reasonable reinvestigation. These accounts were verified without proof. FCRA 611 ( a ) ( 6 ) ( B ) ( iii ) After reinvestigation, bureaus must disclose their verification method. This was not provided.
