I am filing this complaint to dispute a solar loan originated through Sunlight Financial for a project that was never completed and is in violation of local building codes and safety standards. The XXXX, XXXX XXXX, materially breached the contract, and Sunlight Financial has refused to acknowledge my legal right to dispute the loan. Here are the facts : I entered into a contract with XXXX XXXX to install a residential solar energy system along with a new main electrical panel and a generac stand by generator. The project was never completed and was left in an unsafe, non-functional, and non-compliant state. certain required permits were not obtained, and multiple components of the electrical work are not up to code. Multiple items were not properly installed include of the generator and main panel and my property has been left in an unsafe condition due to incomplete and substandard work. The generator is not up to code per multiple standards including but not limited to the following. XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX No permit or inspection was done for the generator install electrical or mechanical for the gas line. The main panel on the inside of my house had no permit pulled and violated the following. Violation of Michigan Electrical Code Rule 801 Legal Citation : Michigan Administrative Code R 408.30801 ( Rule 801 ) NEC 2023 Section 110.22 ( A ) They also failed to finish hooking up wires that I had to pay someone else to finish of which they stated they would repay. XXXX XXXX has gone out of business andappears to have abandoned the project. Despite this, Sunlight Financial is continuing to bill me and withdraw monthly auto-debits for a system that was never properly delivered or functional. Under the FTC Holder Rule ( 16 C.F.R. 433 ), I have the legal right to assert the same claims and defenses against the loan holder ( Sunlight Financial ) that I could assert against the seller ( XXXX XXXX ). This includes the right to withhold payment due to breach of contract and failure of consideration. Sunlight Financial has ignored this and continues to demand payment, which I believe violates both federal consumer protections and the Michigan Consumer Protection Act. I am requesting the following : Immediate suspension of all loan payments and auto-debits A formal investigation into Sunlight Financials financing of XXXX XXXX contracts Permanent cancellation of this loan due to contractor fraud and failure to deliver the promised goods and services I have attempted to resolve this directly with Sunlight Financial, but they have refused to acknowledge the legal basis of my dispute. I am requesting that the CFPB investigate this matter and help enforce my consumer rights.
