I am submitting this formal complaint against EdFinancial Services for reporting false, misleading, and re-aged derogatory data on my credit report, in violation of the Fair Credit Reporting Act ( FCRA ), Metro 2 standards, and Department of Education servicing guidelines. This loan was a federal student loan originated in XX/XX/XXXX, with a XXXX maturity period, making it legally mature by XX/XX/XXXX. Despite this, EdFinancial is reporting false delinquencies in XXXX well beyond the loans maturity including a fabricated Date of First Delinquency ( DOFD ) of XX/XX/XXXX. This constitutes illegal re-aging under FCRA 623 ( a ) ( 5 ), as well as willful misrepresentation of a federal debt. Additionally, EdFinancial : Inflated the account balance from the original ~ {$3600.00} to over {$4700.00}, which exceeds the highest reported credit limit and has no supporting documentation. Failed to notify me before ending administrative forbearance or resuming repayment, violating federal servicing protocols. Did not respond to three separate certified disputes I sent : XX/XX/XXXX Initial dispute XX/XX/XXXX Final demand for correction or deletion XX/XX/XXXX Legal addendum citing additional violations These letters demanded : Removal of all inaccurate late payment history Correction of DOFD to reflect actual account history Application of retroactive forbearance Deletion of the tradeline if compliance could not be met To date, EdFinancial has failed to comply. Their false reporting has caused credit damage, mortgage delay, and substantial distress. This is willful noncompliance under FCRA 616617, and I am prepared to pursue statutory and actual damages in court if this is not corrected. I am requesting : Full deletion of the EdFinancial tradeline from all three credit bureaus Formal response from the company within 10 calendar days Referral to the Department of Educations FSA Ombudsman, and/or enforcement division, if they fail to respond All supporting documents, certified letters, and screenshots are available upon request.
