Consumer Narrative

Subject : Formal Dispute XXXX XXXX Credit Card ( Charge-Off / Profit & Loss Write-Off Reporting ) To TransUnion, Experian, and Equifax and XXXX XXXX XXXX I am formally disputing the XXXX XXXX credit card tradeline currently appearing on my credit reports. The reporting is inaccurate, contradictory, and unverifiable. I demand either a full correction or the immediate removal of this tradeline across all credit bureaus. XXXX. Manipulated and Backdated Delinquency XXXX has repeatedly altered the reported first delinquency date.... first XXXX, then XXXX, and now XXXX. These retroactive changes appear deliberately designed to accelerate a charge-off prior to XXXX transfer of its credit card portfolio to XXXX XXXX XXXX Such manipulation is misleading, prejudicial, and violates the FCRAs requirement of consistent and accurate reporting. XXXX. Contradictory Status Reporting The account is simultaneously listed as : Charge-Off Profit and Loss Write-Off 120+ Days Late ... to 180+ days with Balance Due These statuses can not logically coexist. An account can not be both written off and still accrue delinquency. This dual reporting is inconsistent and materially misleading. XXXX. Profit and Loss Write-Off Without Clarification If XXXX has reported this account as a profit and loss write-off, then one of two things must be true : If the debt has been canceled or forgiven, XXXX must issue a Form 1099-C to me and to the IRS as required by law. If the debt has been sold or transferred, XXXX can not continue reporting a balance, and only the new owner may lawfully report the debt. To date, XXXX has failed to provide any such clarification. XXXX. Incomplete and Inconsistent Bureau Reporting ( every credit bureau seems to be reporting differently and w erroneous information each in its own way ) XXXX reporting is not even consistent across bureaus. Some bureaus show charge-off ; others are in dispute ; still others omit critical remarks. This violates the FCRA requirement that credit information furnished to all bureaus must be complete and accurate.
