Consumer Narrative

I disputed this account via certified letters sent XX/XX/XXXX and XX/XX/XXXX, including ID and proof of address. XXXX XXXX has never mailed a proper validation package. Instead, correspondence was sent to XXXX XXXX XXXX XXXX, XXXX XXXX not my address. My business/employment address is XXXX XXXX. The use of the wrong suite obstructed delivery and prevented me from receiving any meaningful validation. Violations & Issues Failure to Validate No validation package was mailed within 30 days of my certified disputes. The use of the wrong suite number meant any attempted validation never reached me, making the process defective. This violates both the FDCPA ( 15 U.S.C. 1692g ) and FCRA. Re-Aging Across Bureaus TransUnion updated this account on XX/XX/XXXX as past due, despite previously reporting the account as deleted. Experian shows the account past due as of XX/XX/XXXX. Equifax updated the account on XX/XX/XXXX, again showing it as past due. These rolling updates artificially extend delinquency and damage my score prohibited under the FCRA. Conflicting & Inaccurate Reporting Each bureau shows different balances, statuses, and dates. This demonstrates a lack of reasonable procedures to ensure accuracy. Statutory Violations 15 U.S.C. 1681i Failure to conduct a reasonable reinvestigation. 15 U.S.C. 1681e ( b ) Failure to maintain maximum possible accuracy. 15 U.S.C. 1681s-2 Furnishing information known to be inaccurate. 15 U.S.C. 1692g Failure to validate debt. Harm Caused Damaged credit score due to re-aging. Inability to access financing on fair terms. Stress, confusion, and wasted resources tracking disputes obstructed by wrong address errors.
