First contact statement : I was contacted by XXXX XXXX at National Credit Systems Inc. on Wednesday afternoon, XX/XX/XXXX, at XXXXXXXX XXXX, where I was informed of this debt reporting. From that point on, his behavior became very distasteful and blatantly disrespectful, as he kept cutting off the phone when I needed clarity, and I would have to keep calling back for it. He felt that at that moment, I was at his mercy to try to resolve this debt so that it would not destroy my credit unnecessarily. I was much more nave then, to the information that I know today, and unfortunately, XXXX XXXX and XXXX XXXX have capitalized on that, which speaks volumes to their character and their practices as a business. I explained to him how the original creditors, XXXX XXXX XXXX XXXX XXXX, refused to tell me what the balance completely entails, as I was not given any transparency from them, among several other things. He tried to bribe me into paying half of the full amount if he reduced it to {$16000.00}, versus the original amount. I knew that that was not how any business operates ; he was just trying to get his percentage of that money through using intimidation tactics. I knew that I was entitled to a mediation or some sort of dispute process, or legal representation if I had it. Once I mentioned this, he then mentioned that other processes would need to be taken if legal representation is involved ; however, I can report the debt through their dispute process. While I requested this, XXXX XXXX did not allow me to complete my dispute before reporting the collection to XXXX credit bureaus under my mom and myself. It is important to note that both he and his assistant, XXXX XXXX, were very accusatory and seemed to already have their opinions on my situation, which they had no context of. Again, this and every situation leading to the repossesion and now inaccurate debt reporting is thoroughly reported in the documentation I have provided. The original creditors have committed crimes of theft, mail fraud, refusal to address the true amount of debt that they claim I owe ( fraudulent debt reporting ), refused to mediate the amount, provide transparency, refused to allow monthly payments despite providing my month-to-moth notice, and in every instance, ignored me and others who attempted to reach them regarding my property and this debt, including their lawyer, who refuse to communicate with another XXXX Legal Aid attorney who reached out to him on my behalf, and National Credit Systems doing the absolute same by violating my rights under Fair Credit Reporting Act ( FCRA 611/623 ) and the Fair Debt Collection Practices Act ( FDCPA 809 ( b ) ). I will not stand for this activity. Since XX/XX/XXXX, I have been contacted, intimidated, harassed, spoken down to, and have continually been a victim of misconduct and false credit reporting by National Credit Systems LLC. This has been the most distressing, intimidating, and XXXX-inducing experience for me, as I have been deliberately mistreated and given false information for years, to benefit National Credit Systems and their money hunger. Today, XX/XX/XXXX, I contacted XXXX XXXX, the agent over my and my Mom 's account. This was because last week, Friday, XX/XX/XXXX, I was contacted by XXXX XXXX, who called stating that a settlement amount was reached and sent over to me on XX/XX/XXXX. However, despite National Credit Systems being aware that they are representing an inaccurate and fraudulent debt, which they bought from XXXX XXXX XXXX apartments, they have continuously intimidated me into payment, despite already falsely reporting this collection amount of over {$25000.00} to all three credit bureaus since XX/XX/XXXX. Almost XXXX years later, we are still fighting this injustice. Over the phone on Friday, XX/XX/XXXX, I was informed by XXXX XXXX that while they JUST sent over this settlement amount on XX/XX/XXXX, they are only giving us until the end of the month, by XX/XX/XXXX, to settle the account. Otherwise, I will go back to the {$25000.00} amount. XXXX XXXX also lied over the phone today, XX/XX/XXXX, by stating that I was given a settlement amount since XXXX. As I stated, I was not given the settlement amount until XX/XX/XXXX. Again, this is probably the XXXX tactic they have used to get me to scramble and pay them in fear and contradict themselves over the phone. While this collection is affecting my and my mom 's livelihood and ability to have Housing, this man and the other associates with National Credit Systems continue to hang the phone up on me repeatedly, and doing so, are picking and choosing when they decide to clarify information that only they have. I don't know why a company should be allowed to operate this way. The part that is extremely unjust and illegal is their refusal or aid in the removal of the collection from my and my mother 's credit profiles, once they receive payment. On several occasions, they have also refused to send over ANY written communication, including letting us know how they are reporting this collection to the credit bureaus, to launder money from a consumer. Please investigate National Credit Systems and understand that, because of their disgusting business practices, for 3 years, my mom and I have not been able to have a roof over our head because all people see is that collection on our credit profile. The behavior of XXXX XXXX and the first representative who contacted me, XXXX XXXX, NEEDS to be banned, as this is just XXXX example. I also have several recordings of these calls where I have been hung up on by both XXXX XXXX, his XXXX, XXXX XXXX XXXX, and XXXX XXXX. Today, XX/XX/XXXX, I was hung up on by XXXX XXXX, yet again. XXXX XXXX has repeatedly talked over me, has refused to provide clarity, and even give us time to address the collection, as it has been proven fraudulent on many occasions. Here is why : The property that National Credit Systems took this amount from, XXXX XXXX XXXX XXXX, was raided by the FBI on XX/XX/XXXX, due to running a rent price scheme and severe negligence, as well as violating antitrust laws. This property, including XXXX other XXXX properties, was investigated by the Department of Justice and ultimately sued by the Colorado Attorney General in XX/XX/XXXX to settle for the thousands of residents affected, myself being XXXX of them. I documented all that took place, correlating with this investigation, in a XXXX lawsuit against XXXX XXXX XXXX and National Credit Systems . I have been a victim of National Credit Systems for years, as they have violated the Fair Debt Collection Practices Act on several occasions, and we do not deserve for our lives and housing to be affected anymore. Unfortunately, I am unable to attach my most recent call recording with XXXX XXXX from today, Friday, XX/XX/XXXX. However, in the call, he stated that we have had the settlement since XX/XX/XXXX. No settlement was received until XX/XX/XXXX, as I also have a recording of him letting me know this as well. Otherwise, I would have known. As I mentioned above, I did not receive any settlement until XX/XX/XXXX. Again, he has lied, attempted to shorten the timeframe, and, despite knowing the details of this fraudulent debt, is still intimidating us with payment. In this call, he repeated to me that even once a settlement is paid, they will not aid in the removal of the collection from our credit report, which has significantly impacted us. Therefore, essentially, XXXX XXXX is comfortable taking our money and not providing the proper service or reporting. In this call, he also contradicts himself multiple times by stating that " the settlement is only valid for the month of XXXX '' ; however, he goes on to say that " the settlement is month-to-month. '' He proceeded to hang up the phone, yet again, and while I attempted to call back, he did not pick up the phone. I continue to be subjected to misconduct and a belligerent me and hanging up the phone, despite my needs and despite him having practices to uphold as a debt collector. Consumer Financial Protection Bureau, I urge you all to PLEASE investigate National Credit Systems Inc. because I can not continue to be affected by this company anymore. I have suffered emotional distress and turmoil, intimidation, harassment, malpractice from a business, etc., which is all enough to personally sue National Credit Systems Inc. for all they have caused my mom and I to suffer through.
