Consumer Narrative
I am filing a follow-up complaint against First Federal Credit Control for XXXX to violate the Fair Credit Reporting Act ( FCRA ). This company claimed in my first complaint that they mailed me validation of the alleged debt ( Acct # XXXX XXXX XXXX XXXX XXXXXXXX, {$830.00}, XXXX XXXX ). It has been over 30 days and I have never received anything at my address on file. That means their response to my first CFPB complaint was false and misleading. Meanwhile, First Federal continues to report this collection account to Experian, Equifax, and TransUnion without giving me a single shred of proof. To report a debt without mailing me proper validation is outrageous, reckless, and unlawful. The Law : 15 U.S.C. 1681i ( FCRA 611 ) : Credit reporting must be reinvestigated and verified within 30 days. Over XXXX days have passed and First Federal has failed to provide anything. 15 U.S.C. 1681i ( a ) ( 5 ) ( A ) : If an account can not be verified, it must be deleted not updated or left as 'remains. ' 15 U.S.C. 1681i ( a ) ( 7 ) : I never received a description of the procedure used to 'verify ' this account, as the law requires. 15 U.S.C. 1681e ( b ) : They are not ensuring maximum possible accuracy. 15 U.S.C. 1681s-2 ( b ) : As a furnisher, First Federal is required to investigate and delete unverifiable data when notified. They have ignored this. 15 U.S.C. 1681n & 1681o : Their failure to comply subjects them to civil liability for negligent and willful noncompliance, and I am prepared to pursue a federal lawsuit if this is not corrected. My Demands : 1. Delete this unverifiable collection account from all credit bureaus immediately. 2. Provide lawful validation if they believe they have any this must include : A wet-ink signature contract with the original creditor. A valid assignment agreement or bill of sale proving First Federals right to collect and report this account. Without this documentation, First Federal has no legal right to continue reporting this debt. Their behavior is harming my life and opportunities, and I will not hesitate to file lawsuits in federal court if they do not comply. Final Note : Once again, under 15 U.S.C. 1681i ( a ) ( 7 ), I am demanding the description of the procedure used to 'verify ' this account. First Federal has not provided this, and their failure to do so is further evidence of noncompliance
