Consumer Narrative
writing to formally address an issue regarding the repossession of my vehicle, a XXXX XXXX, which I co-financed with my father in XXXX through Nissan Motor Acceptance XXXX ( NMAC ). Both my father and I are co-signers on the loan. In XX/XX/XXXX, my father filed for bankruptcy. Following this, in XX/XX/XXXX, XXXX XXXX ceased communication with me entirely, despite the fact that I am a co-borrower on the loan. My fathers bankruptcy attorney clarified to Nissan that the vehicle was not included in his bankruptcy filing. Nonetheless, Nissan continued to refuse communication with me as the co-signer. In XX/XX/XXXX, I unfortunately missed a payment. I received no warning, no notice of default, and no opportunity to bring the account current. On XX/XX/XXXX, my vehicle was repossessed without any prior notification, explanation, or attempt to collect or settle the past-due balance with me directly. Upon contacting Nissan Finance after the repossession, I was initially told they would not speak to me due to my father 's bankruptcy. When I expressed my concern and mentioned potential legal action, they then claimed that I would have to pay the full balance of the loan in order to retrieve the vehicle. I again clarified that the vehicle was not included in my fathers bankruptcy, and I am not filing for bankruptcy. Despite this, I was denied the opportunity to cure the default or reinstate the loan. This experience raises serious concerns about : Failure to properly notify a co-borrower of default and repossession Improper communication refusals based on a third partys bankruptcy Denial of the right to reinstate or pay past-due amounts Potential violation of state and federal consumer protection laws, including the Fair Debt Collection Practices Act ( FDCPA ) and possibly the Uniform Commercial Code ( UCC ) governing repossession procedures I am requesting the following : A full account history of the loan, including payment records and notices sent Documentation stating why the repossession occurred and what communications ( if any ) were sent to me A clear explanation as to why I was not given the opportunity to cure the default Immediate review and correction of any errors resulting from improper handling of this matter Please consider this my formal dispute of the repossession and a request for resolution. If this matter is not resolved promptly,
