Consumer Narrative

I am making an additional complaint in regards to TVC funding - XXXXXXXX XXXX XXXX Scheme as i have identified some new additional information related to this exact scheme these XXXX XXXX Fraudsters have conspired together to carry out. XXXX is a partner of TVC Funding https : //www.tvcfunding.com/XXXX neither of them have Mortgage Brokers license in Texas evading TILA, RESPA, and engaging in Deceptive trade practices and Securities laws. This new information I have obtained is from the DOJ Website. TVC Funding is also not registered with the TX Comptrollers office and still carries out business in the State of Texas regardless as i have deed records that are public information and have sidted through them. I want this complaint on the record along with the information white paper from the DOJ. Exhibit X : XXXX XXXX XXXXXXXX XXXX XXXX XXXX vs. XXXXTVC Practices Source : XXXX.S. Department of Justice , Executive Office for U.S. Trustees , Mortgage Fraud and Mortgage Rescue Schemes : How Panel Trustees Can Help Uncover These Schemes ( 2 Legal Argument : DOJ-Recognized Mortgage Rescue Fraud Renders Contracts Void The transactions at issue are not legitimate property transfers. They are fraudulent mortgage rescue/saleleaseback schemes that have been expressly identified and condemned by the United States Department of Justice XXXX The DOJs Executive Office for U.S. Trustees, in its XXXX publication Mortgage Fraud and Mortgage Rescue Schemes : How Panel Trustees Can Help Uncover These Schemes, sets forth the precise indicators of fraudulent mortgage rescue practices. As shown in Exhibit X, Defendants XXXX, TVC Funding, and their affiliates engage in conduct that mirrors the DOJs description point-for-point, including : 1. Obtaining deeds from distressed homeowners under false pretenses. 2. Leasing properties back under inflated and unaffordable terms. 3. Stripping homeowner equity while creating illusory repurchase options. 4. Utilizing multiple shell entities to conceal ownership and evade liability. 5. Filing suspicious instruments with signs of alteration or defective notarization. 1. Fraud and Misrepresentation Render Contracts Voidable Under Texas law, a contract induced by fraud is voidable Texas : Fraudulent inducement renders a contract voidable ; the contract can not stand if procured through fraud. ( XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX ( XXXX. XXXX ) ). Because the deeds and leasebacks were procured through fraud, they are subject to rescission. XXXX. Contracts That Violate Public Policy Are Void Ab Initio Even apart from inducement, contracts that contravene public policy are void ab initio and unenforceable. Texas : A contract that is illegal or against public policy is void and can not be enforced. ( XXXX XXXX XXXX, XXXX XXXX XXXX ( XXXX. XXXX ) ). The DOJ guidance establishes that saleleaseback rescue schemes are fraudulent and contrary to public policy, as they strip equity from vulnerable homeowners. XXXX. Fraudulent Documents Can not Confer Legal Rights The use of altered affidavits, fraudulent notarizations, and defective filings further voids any claimed rights under these instruments. Texas : A forged deed is a nullity and passes no title. ( XXXX XXXX XXXX, XXXX XXXX XXXX ( XXXX. XXXX ) ). Thus, any eviction, foreclosure, or property transfer relying on such instruments is legally void. XXXX. XXXX Does Not Apply This case does not seek review of a state-court judgment, but rather challenges independent fraud and securities violations that the state court never adjudicated. XXXX XXXX XXXX XXXX XXXX XXXXXXXX both recognize that extrinsic fraud is an exception to XXXX. ( XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Conclusion The contracts and transfers at issue are fraudulent, illegal, and against public policy as recognized by the United States Department of Justice. Under controlling Texas law, such contracts are void and unenforceable, and any actions taken pursuant to them ( including eviction or foreclosure ) must be rescinded and dismissed. XXXX nor TVC Funding do not hold a valid Mortgage Brokers license in Texas - evasion doesnt work or the statement We have no contract with You we loaned XXXX XXXX XXXX XXXX XXXXXXXX XXXX XXXXThey sure did they are part of the Conspiracy and the Equation they funded XXXX which makes them a suspect and apart of the Deceptive Practices My property deed was used to secure funding FRAUD I will not stay silent and will continue reporting them until they are held accountable for stealing my equity and hundreds of others across the US. I have also attached a copy of XXXX XXXX form that shows XXXX is using virtual addresses to avoid litigation and service of process. XXXX is one of TVC Funding XXXX as stated above. TVC funded XXXX and are part of the Equation no grey areas
