CFPB Complaint Draft Subject : Incorrect Date of First Delinquency Reported Account XXXX XXXX Summary of Issue : My credit report is inaccurately reporting the Date of First Delinquency ( FDOD ) for a closed credit card account ( XXXX XXXXXXXX ). Date of 1st Delinquency reported : XX/XX/XXXX Date account closed : XX/XX/XXXX It is impossible for this account to have a new delinquency date in XXXX because it was closed in XXXX. This appears to be an unlawful attempt to re-age the debt to keep it on my credit report longer than allowed. Why this violates the law : Under the Fair Credit Reporting Act ( FCRA 623 ( a ) ( 5 ) ), furnishers are required to accurately report the Date of First Delinquency and may not misrepresent or alter it. Under FCRA 605 ( a ), negative information ( like charge-offs ) may only be reported for 7 years from the true FDOD. By reporting a FDOD in XXXX, the furnisher and/or bureau are violating federal law and extending the reporting period beyond the 7 years permitted.
