Re : Formal Dispute of Inaccurate Charge-Off / Late Payment Reporting To Whom It May Concern, I am writing to dispute the accuracy and validity of a charge-off/late payment reported by XXXX XXXX on my account, which has been furnished to the consumer reporting agencies. After reviewing my credit file, I believe this reporting is inaccurate, unverifiable, and in violation of federal law. Legal Basis for Dispute Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681s-2 ( a ) ( 1 ) ( A ) prohibits furnishers of information from reporting data they knowor should reasonably knowto be inaccurate. Unless you can provide the following documentation, the late payment/charge-off must be withdrawn from all credit reporting agencies to which you have furnished it : Original signed account agreement. Complete payment history and billing statements covering the alleged period of delinquency. Documentation proving proper notice of delinquency was provided to me, in compliance with applicable laws. If XXXX XXXX can not produce this documentation, you are legally obligated to immediately notify Experian, TransUnion, and Equifax that the reported information is inaccurate and must be deleted. Notice of Compliance Failure to comply with these requirements will be considered willful noncompliance under 15 U.S.C. 1681n, exposing XXXX XXXX to liability for statutory damages, attorneys fees, and costs. I respectfully request written confirmation within 30 days of receiving this notice that either : The disputed charge-off/late payment entry has been deleted from all consumer reporting agencies ; or Documentation supporting the validity of the reporting has been provided to me.
