As a victim of identity theft, I requested documentation from the collector to validate the debt in question. This request is my right under the Fair Debt Collection Practices Act. The collector has ignored both of my requests despite receiving documentation to support the identity theft. The collector is aggressively seeking a judgement for the debt through the court. Immediately following the initial court date, the collector sent me an Affidavit to sign that asks me to provide them with how much I think I owe on the account, the listed users on the account, when the fraudulent transactions occurred, and five samples of how I sign my name for law enforcement. It seems that the collector is ignoring the fact that identity theft involves the fraudulent acquisition and use of a person 's private identifying information, usually for financial gain. The collector was provided with documentation from the local police, FBI and IRS to validate the fraud.
