Consumer Narrative

On XXXX XXXX XXXX, a fraudulent student loan in the amount of {$1800.00} was opened in my name without my knowledge or consent. This account has since been placed in collections and has caused significant harm to my credit standing. I have filed four separate disputes with TransUnion regarding this account. Each time, I have clearly stated that the account is fraudulent and does not belong to me. XXXX promptly investigated, confirmed the account was fraudulent, and removed it from my credit file. TransUnion, however, has failed to conduct a reasonable reinvestigation as required under the Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681i. Instead, they have repeatedly verified the account as accurate, despite my statements and the contradictory findings of another national credit bureau. TransUnion has stated that my only recourse is to submit additional documents, which I do not possess because this account is not mine. This position ignores the obligations under the FCRA to investigate disputes using all information reasonably available, including information from other credit reporting agencies and the furnishing creditor. By failing to remove the fraudulent account, TransUnion is in violation of its statutory duties under the FCRA, including but not limited to : Failing to conduct a reasonable reinvestigation ( 1681i ) Failing to delete inaccurate or unverifiable information ( 1681i ( a ) ( 5 ) ) Continuing to report information it knows or should know is inaccurate ( 1681e ( b ) ) I request immediate removal of the fraudulent account from my credit report and written confirmation of this action. If TransUnion fails to correct this matter promptly, I will pursue further remedies through the Consumer Financial Protection Bureau ( CFPB ), the Federal Trade Commission ( FTC ), and private legal action as allowed under the FCRA.
