Consumer Narrative
I am filing this complaint against TransUnion for violations of the Fair Credit Reporting Act ( FCRA ), specifically under 15 U.S.C. 1681i, which requires credit reporting agencies to conduct a reasonable reinvestigation of disputed information, mark disputed items as in dispute on credit reports, and correct or delete inaccurate information within 30 days. On XX/XX/XXXX, at XXXX XXXX XXXX, I contacted TransUnion by phone ( call duration : 18 minutes, to ( XXXX ) XXXX ) to dispute two inaccurate items reported by the furnisher XXXX ( account ending in XXXX ) on my credit report : 1. An inaccurate balance reported for the XXXX account. My TransUnion credit report, last updated XX/XX/XXXX, shows an open balance of {$470.00} against a {$350.00} credit limit ( 136 % utilization ), while my XXXX account statement as of XX/XX/XXXX, reflects a current balance of only {$6.00} with a statement balance of {$0.00}. 2. A negative item ( late payment ) reported for XX/XX/XXXXXXXX and XX/XX/XXXX. My XXXX transaction history shows a payment of {$470.00} made on XX/XX/XXXX, covering the prior month, and consistent payments except for the flagged months, suggesting improper reporting. During the call, I provided details supporting my dispute, including payment records from XXXX showing the correct balance and transaction history. However, TransUnion failed to note these items as disputed on my credit report, as required by FCRA 1681i ( a ) ( 6 ) ( B ), and continues to report them as accurate without updates. This has harmed my credit score, with a reported 136 % utilization and late payment marks causing difficulties in obtaining new credit and increasing interest rates, leading to financial damages estimated at {$500.00} in higher interest payments. Under FCRA, TransUnion is obligated to : Promptly notify the furnisher ( XXXX ) of the dispute and provide all relevant information I supplied. Reinvestigate the dispute free of charge and within 30 days. Update my credit report to reflect the dispute status while the investigation is ongoing. Delete or correct the information if it can not be verified as accurate. TransUnion has not complied with these obligations, leading to willful or negligent violations of the FCRA. I have reviewed my updated credit report as of XX/XX/XXXX, and the items remain unchanged and unmarked as disputed. I request that the CFPB investigate this matter and require TransUnion to : 1. Immediately remove the inaccurate {$470.00} balance and late payment items for XX/XX/XXXXXXXX and XX/XX/XXXXXXXX from my credit report. 2. Award compensation for actual damages, including {$500.00} in higher interest payments, as well as statutory damages up to {$1000.00} per violation under FCRA 1681n if willful noncompliance is found. 3. Cease any further reporting of these items without proper verification. I am attaching supporting documents, including my XXXX account statement ( showing {$6.00} balance and {$470.00} payment on XX/XX/XXXXXXXX ), TransUnion credit report ( showing {$470.00} balance ), and call logs from XX/XX/XXXX, confirming my dispute. Thank you for your assistance in resolving this issue and holding TransUnion accountable.
