FINAL CFPB COMPLAINT & LEGAL DEMAND MULTIPLE WILLFUL VIOLATIONS OF FCRA 605B BY EXPERIAN Since XX/XX/XXXX, I have submitted XXXX complete and valid identity theft blocking requests under FCRA 605B to Experian, each including : ( 1 ) FTC Identity Theft Report, ( 2 ) government-issued ID, ( 3 ) proof of current address, and ( 4 ) a credit report clearly identifying fraudulent items. In each round, Experian partially deleted fraudulent information confirming that my documentation was valid, that the disputed items resulted from identity theft, and that Experian had the technical ability to remove all such information. Despite these acknowledgments, Experian willfully refused to block the fraudulent XXXX XXXX account ( Account # : XXXXXXXX XXXX XXXX XXXX XXXX ) and multiple unauthorized hard inquiries ( XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXX/XX/XXXX ), instead repeatedly applying 611 reinvestigation procedures by contacting furnishers for verification a process explicitly prohibited under 605B once a valid Identity Theft Report has been submitted. FCRA 605B requires blocking all identity theftrelated information within four ( 4 ) business days of receiving a complete request. The law provides no discretion for partial blocking, selective removal, or repeated verification. By partially deleting some items while retaining others from the same theft event, Experian engaged in intentional, selective enforcement of the law, in direct violation of FCRA 605B, 607 ( a ), and 610 ( a ). Failure to comply will result in immediate filing of a federal lawsuit and referral to the CFPB, FTC, and Office of the Attorney General, seeking maximum statutory, actual, and punitive damages. Your repeated partial deletions have created irrefutable proof of willful violations and a clear pattern and practice of noncompliance, guaranteeing liability in court. Your actions are indefensible. You have admitted my documents were valid ( by deleting other items ), admitted the theft occurred, and admitted you could delete the information yet you chose not to.
