I am filing this complaint regarding the inaccurate and harmful reporting practices of EDFINANCIAL in relation to my persons XXXX XXXX consumer credit file for XXXX. I, the living man XXXX XXXX, have been a victim of identity theft and have been trying to resolve this issue for over XXXX months, and despite numerous attempts to resolve the issue, fraudulent accounts and unauthorized credit inquiries continue to appear on my consumer report. These inaccuracies have severely damaged my creditworthiness and caused me ongoing harm. For over XXXX months, I have taken consistent action to dispute fraudulent activity that has been reported on my consumer file. Despite my diligence, fraudulent accounts and inquiries remain on my report, which I have clearly identified as resulting from identity theft. XXXX of the most egregious examples is the presence of a fraudulent federal Student loan from EDFINANCIAL opened on XX/XX/XXXX. This fraudulent account was opened on XX/XX/XXXX with a balance of XXXX XXXX As well as an even more horrendous account in the amount of XXXX XXXX This amounts to over XXXX $ in fraudulent federal student loan funding. I have never applied for or received a federal student loan and I have never attended college at XXXX XXXXXXXX university which is where the alleged student loan originated from. The account was opened without my knowledge or consent. The account shows little payment history and multiple XXXX, XXXX and XXXX day late payments, which further supports my claim that a criminal opened this account using my stolen personal information. I have also called EDFINANCIAL back in XXXX of XXXX to start an internal investigation on this matter and was told that payments would be deferred until they received a ftc report regarding the fraudulent account. Legal Grounds : Under the FCRA ( 15 U.S. CXXXXe XXXX ) and XXXX XXXX XXXX, consumers have the right to block information resulting from identity theft : A consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, no later than XXXX business days after the receipt by such agency of : ( XXXX ) Appropriate proof of the identity of the consumer ; ( XXXX ) A copy of an identity theft report ; ( XXXX ) The identification of such information by the consumer ; ( XXXX ) A statement by the consumer that the information is not information relating to any transaction by the consumer. I have already provided all XXXX items, including my FTC Identity Theft Report, a copy of my ID, a list of the fraudulent items, and a signed written statement. If EDFINANCIAL, and XXXX does not take corrective action and resolve this matter fully and in compliance with the FCRA, I will pursue legal remedies, including : A federal lawsuit for FCRA violations A state lawsuit for civil non-compliance and damages Claims for emotional distress, financial harm, and pain and suffering as a result of this ongoing negligence This issue must be addressed with the urgency it deserves.
