Consumer Narrative

Under 15 U.S. Code 1681c-2, Consumer Reporting Agencies ( CRAs ) are legally obligated to block any information in a consumers file that the consumer identifies as the result of alleged identity theft. This blocking must occur within four ( 4 ) business days of receiving : ( 1 ) proof of the consumers identity, ( 2 ) a valid identity theft report, and ( 3 ) identification of the disputed information. Although the statute does not explicitly define proof of identity, I have provided the following identifying information as it appears on my credit file : Full Name : XXXX XXXX Date of Birth : XX/XX/XXXX Last Four Digits of XXXX : XXXX Current Address : XXXX XXXX XXXX, XXXXXXXX XXXX XXXXXXXX Government-Issued Photo ID Number : XXXX A copy of my FTC Identity Theft Report, Report # XXXX, is attached. The Fair Credit Reporting Act does not require a consumer to provide their full Social Security Number to exercise their rights under 1681c-2. Therefore, the information above is sufficient for verification purposes. The disputed information identified in this complaint includes the following accounts, which are being reported without a permissible purpose under the FCRA, 15 U.S. Code 1681b. Because these entities have no permissible purpose to access or report my credit information, their actions violate the FCRA and prompted my 1681c-2 block request. Reporting accounts without authorization or a permissible purpose constitutes aggravated identity theft under 18 U.S.C. 1028A. I request that the CRA immediately block and remove all disputed accounts from my credit file in compliance with federal law. Under 15 U.S. Code 1681c2, you are legally required to block and remove all disputed information within four ( 4 ) business days of receipt of my identity theft report, proof of identity, and identification of the disputed items. Accordingly, I am demanding that you permanently delete all listed charge-offs and provide me with an updated copy of my consumer report reflecting these deletions. Failure to comply will constitute a willful violation of the Fair Credit Reporting Act and further violations of 15 U.S.C. 1681n, 15 U.S.C. 1681o, and 18 U.S.C. 1028A ( Aggravated Identity Theft ).
