Subject : Complaint Against Selene Finance Improper Handling oXXXX XXXX XXXX XXXX and FHA Partial Claim Misinterpretation- Additional complaint re : CFPB case # XXXX Re : XXXX account # XXXX To Whom It May Concern : I am submitting this formal complaint against Selene Finance LP for their mishandling of my mortgage account during and after my participation in a XXXX Trial Payment Plan, and for what appears to be a misapplication of FHA guidelines related to a Partial Claim. Background : My mortgage was previously serviced by XXXX XXXX, who approved me for a XXXX Trial Payment Plan. I made all required payments of {$2100.00} in XXXX and XX/XX/XXXX to XXXX and in XX/XX/XXXX to Selene Finance after the servicing transfer. I continued to make timely monthly payments in XXXX and XX/XX/XXXX and intend to pay XXXX on time as well. Despite this, Selene is : 1. Claiming I am three or more payments behind, which is incorrect. XXXX. Refusing to finalize the XXXX XXXX XXXX modification based on that status. Key Concern : I understand that while the original XXXX program allowed for both delinquent and non-delinquent borrowers experiencing financial hardship to qualify for a modification, Selene is now citing FHA Partial Claim rules that allegedly require me to be three months delinquent to finalize the paperwork. This is inconsistent with : My trial plan approval and successful completion. The FHAs own guidance, which allows for case-by-case evaluation. The fact that I have remained current and have documentation to prove it. Request for CFPB Assistance : I request that Selene Finance correct my account records, acknowledge I am current, and complete the XXXX final modification process. I also request a review of Selenes interpretation of FHA guidelines, as it appears to be a misapplication causing unnecessary delay and hardship. Finally, I ask that CFPB ensure no negative credit reporting or servicing action is taken based on this incorrect delinquency status Here are my payment confirmations : XXXX.
