To Whom It May Concern this is my second formal complaint against multiple credit reporting agencies and furnishers who continue to report inaccurate, misleading, and unverifiable information on my credit report despite my previous dispute and ongoing financial hardship I have already filed a complaint which is still open and this submission includes additional and repeated violations of my consumer rights under the Fair Credit Reporting Act ( FCRA ), Fair Debt Collection Practices Act ( FDCPA ), and CARES Act I have not yet submitted to the FTC because I wanted to give the CFPB and relevant institutions a fair chance to resolve this matter below I have outlined each item of dispute along with its specific issue and the applicable legal reference The accounts listed below are being reported inaccurately, unlawfully, and in a manner that violates the Fair Credit Reporting Act, the Fair Debt Collection Practices Act ( FDCPA ), and my right to due process. These errors are impacting my financial health, employment opportunities, and mental well-being. I request a full reinvestigation, and removal where applicable. XXXX Account XXXX * * ( Two Entries ) * * Date Opened : XX/XX/XXXX | Balances : {$2000.00} & {$3600.00} | Issue : Late Payment Reporting Issue : These accounts have been reported with late payments despite pandemic-related deferment and administrative forbearance protections under the CARES Act. I was under the understanding that student loan payments were paused and non-delinquent during this period. Reporting late payments violates CARES Act 3513 and FCRA 1681s-2 ( a ) ( 1 ) ( A ), which prohibits furnishing false or misleading information. Under FCRA 623 ( a ) ( 1 ) ( A ) and Regulation B ( Equal Credit Opportunity Act ), creditors must provide fair access to accommodations and not report misleading payment behavior during hardship, especially when consumers request help in good faith. These late payments do not reflect my intent or ability, and reporting them violates my rights. No billing statement or opportunity to make the payment on time was received. Reporting a delinquency within XXXX days of account opening contradicts FCRA standards and indicates furnisher negligence under 1681s-2 ( b ). These need to be investigated and removed immediately. this continued reporting of false, misleading, and damaging information is a violation of FCRA 1681i which requires reinvestigation upon dispute and 1681s-2 ( b ) which obligates data furnishers to correct or delete inaccurate information failure to act will leave me no choice but to escalate further to the FTC and pursue legal action under FCRA 616 and 617 which allows me to seek actual damages, punitive damages, and attorney fees I request immediate investigation removal of the accounts and inquiries listed above and written confirmation of the results of your review thank you for your attention to this urgent and ongoing matter
