I am filing this complaint against Capital One Bank ( USA ), N.A. for attempting to collect on a charged-off debt that they no longer legally own. Based on my research and understanding, this alleged debt was securitized into the Capital One XXXX XXXX ( XXXX ), which means Capital One is no longer the lawful owner and lacks standing to collect or report the debt.Despite this, Capital One has continued to engage in the following unlawful actions : XXXX. Attempting to collect the debt through correspondence and/or third-party agents without proof of ownership. On {$1900.00} and {$1700.00}. XXXX. Reporting an active balance to the credit reporting agencies under Capital One 's name, even though the account was charged off and presumably sold or securitized. XXXX. Refusing to provide full chain of title, XXXX and Servicing Agreement, or agency documentation when formally requested. XXXX. Failing to investigate and correct disputed credit information in violation of the Fair Credit Reporting Act ( FCRA ) .These actions appear to be in violation of the Fair Debt Collection Practices Act ( FDCPA ) and the FCRA XXXX
