Subject : Dispute of Unauthorized Collection Reporting Midland Credit Management Inc To Whom It May Concern, I am writing to file a formal complaint and demand immediate investigation and removal of a collection account that has been improperly reported to my credit file by Midland Credit Management Inc ( Account opened on : XX/XX/year>, Balance : {$540.00} ). Nature of the Dispute : This alleged debt was never validated, and I have no contractual obligation to Midland Credit Management Inc. If the debt was purchased, I was not a party to that transaction and therefore do not owe Midland Credit Management any payment whatsoever. Under the Fair Debt Collection Practices Act ( FDCPA ) 809 ( a ) and the Fair Credit Reporting Act ( FCRA ) 611, I am exercising my right to dispute this claim as : 1. No signed agreement exists between myself and Midland Credit Management. 2. Midland Credit has failed to validate the debt under 15 U.S. Code 1692g. 3. This account has been placed for collection without proper legal standing or proof of ownership. 4. Reporting such debt without full validation constitutes willful furnishing of inaccurate information, a violation of FCRA 623. Legal Position : The assignment of a debt does not automatically bind the consumer to a third party, absent direct agreement. As such, Midland Credit Management Inc. is not a party in privity of contract with me. They have no legal standing to collect or report this alleged debt without : Full chain of title from the original creditor, A signed agreement showing my consent, Proper notice and opportunity to dispute before reporting. Their continued reporting is not only inaccurate and misleading, it may also constitute defamation of character and credit reputation under state common law. Requested Action : I am demanding that the CFPB : 1. Immediately remove this account from all major credit bureaus XXXX XXXX XXXX XXXX XXXX ; 2. Investigate Midland Credit Management for violations of FDCPA and FCRA ; 3. Require Midland to provide full and complete validation of the alleged debt if they wish to continue reporting it ; 4. Confirm that no further collection attempts or reporting be made without legal proof. If this issue is not resolved immediately, I am prepared to escalate to the FTC, state Attorney Generals office, and pursue legal action for willful noncompliance.
