Dear CFPB, I am filing this complaint regarding the unlawful reinsertion of a previously deleted or resolved credit account reported by XXXX XXXX. This account was reinserted on my credit reports with XXXX XXXX and XXXX without proper verification or notice, in direct violation of the Fair Credit Reporting Act ( FCRA ). Under 15 U.S.C. 1681i ( a ) ( 5 ) ( B ), if a credit reporting agency reinserts previously deleted information, they must : 1. Obtain certification of accuracy from the furnisher before reinsertion, and 2. Provide the consumer with written notice of reinsertion within 5 business days. In my case : This account was previously deleted or resolved, yet it was reinserted. I received no written notice of reinsertion. The credit bureaus failed to conduct a reasonable reinvestigation under 15 U.S.C. 1681i ( a ) ( 1 ). Landmark Financial is furnishing information that is inaccurate or unverifiable, violating 15 U.S.C. 1681s-2 ( a ) ( 1 ) ( A ). I have already disputed this account with all three bureaus and demanded deletion unless proper verification is provided. They have failed to comply with their legal obligations. I am requesting that the CFPB investigate this matter and require : The immediate permanent deletion of the Landmark Financial account from all of my credit reports, and Enforcement of my rights under the FCRA, including potential penalties for noncompliance.
