Consumer Narrative
I previously submitted a formal dispute to this Credit Reporting Agency via the cfpb portal on XX/XX/year>XXXX requesting validation of an account being reported on my consumer report - see Complaint ID XXXX. I identified the account as inaccurate and unverifiable. In that same dispute I specifically requested Validation of the account to include all documentation as the law mandates that the Credit Reporting Agency is obligated to provide if in fact they investigate and determine it to be a verified account and reporting accurately. The agency responded claiming it had completed a " manual verification '' with the furnisher and that the account was verified as accurate. However, this was a misrepresentation and no legally sufficient documentation was ever provided to me as I had specifically requested, nor was any such documentation included in the reinvestigation process by the furnisher, as required by law. Under the Fair Credit Reporting Act ( FCRA ) and Fair Debt Collection Practices Act ( FDCPA ), the CRA and furnisher were obligated to provide documentation sufficient to validate the debt and verify its accuracy. This includes : A copy of the original signed contract creating the alleged debt ( FCRA 1681s-2 ( b ) ( 1 ) ( D ) ; FDCPA 1692g ( b ) ) ; A complete itemized accounting of the balance, including fees, interest, and payments ( FDCPA 1692g ( a ) ( 1 ) ) ; The name and address of the original creditor ( FDCPA 1692g ( a ) ( 2 ) ) ; Proof of legal authority to collect and report the debt ( e.g., chain of title or assignment ) ( FCRA 1681s-2 ( b ) ( 1 ) ( D ) ) ; Evidence that a reasonable investigation was conducted, including evaluation of all consumer-submitted documentation ( FCRA 1681i ( a ) ( 1 ) ( A ), 1681i ( a ) ( 4 ) ). None of this documentation was provided. The credit reporting agency simply parroted information received from the furnisher, which does not satisfy the legal obligation to conduct a reasonable and independent investigation. The FCRA prohibits CRAs from blindly relying on data from third parties. They are directly liable under FCRA 1681i for failing to evaluate the accuracy and validity of disputed information, regardless of the furnisher 's claim. By failing to obtain or provide actual proof of the debt, and by relying solely on unverifiable third-party assertions, the CRA has violated my consumer rights under FCRA 1681i, 1681e ( b ), and 1681s-2 ( b ). Summary of Violations : Failure to conduct a reasonable investigation as required by law ; Improper reliance on unverified third-party information ( " parroting '' ) ; No legally sufficient documentation provided ; Continued reporting of inaccurate, incomplete, and unverifiable information.
