Consumer Narrative
In the spring of XXXX I worked with Specialized Loan Servicing with regard to a debt I thought was XXXX in XXXX. We arrived at a " settlement '' so to speak and they provided me with XXXX options to begin repayment of the loan. I chose option XXXX : Interest only payments with a balloon payment in XXXX. I signed the document and paid over {$57000.00} in arrears to bring my account current. In XXXX of XXXX SLS was changed to Shellpoint mortgage servicing. They mismanaged my payment and said I had to pay principal plus interest. Each rep noted that the change from SLS to Shellpoint was not smooth, thousands of erroneous emails had gone out to people just like me and " not to worry '' we will get it all straightened out. Each month I would speak with someone new and hear the same thing : your case is interesting, it will get resolved. I have not missed a single interest only payment. They have had in their possession for in excess of XXXX year, the document I signed with SLS stating I would pay interest only payments. Despite having this documentation in their possession, in XXXX of XXXX, after a year of exhaustive correspondence and PROOF in my favor, they have put my home into foreclosure. The stress I am under is indescribable. I have been making interest only payments for XXXX months and have phoned them monthly to try to remedy the issue. They have not provided me with a XXXX and in XXXX of XXXX I found out they were calling old phone numbers despite me giving them updated contact information each time I call them. Shellpoint has admitted now ( XX/XX/XXXX ), after 12 months of harassment, that they will " pause the foreclosure '' while they " research '' the document that they have had in their possession this entire time but that only I and a phone rep were able to find and resubmit to the loss mitigation department. I am awaiting their decision and feel sick every single day. They are ruining my credit, I am getting numerous calls and mail daily from real estate agents and other companies, asking to buy my home from me. I am threatened with a short sale, foreclosure and I have sought the advice of an attorney who has advised me that what they are doing is illegal and not unusual. Now my loan has been bought by XXXX and during the transition from XXXX XXXX XXXX XXXX ( the former loan owner ) they have been " unable to take a payment '' from me. I am scared every single day, unfocussed, tearful, and my stomach is in a tight knot. My XXXX XXXX are out of control and all I want to do is sleep.
