I received documents from an unknown company through the ( CFPB ) in response to a dispute, ( Resurgent Capital Services ) stating they are responding to a ( CFPB ) inquiry received on XX/XX/XXXX. As a consumer I'm very confused. How can XXXX different collections companies attempt to collect the same debt? I never received any correspondence about Resurgent Capital Services collecting this debt. I reviewed my consumer report, it states LVNV Funding as the only collections company collecting the debt. According to ( FCRA ) 15 U.S Code 1681, " governs access to consumer credit report records and promotes maximum ACCURACY, fairness, and privacy of personal information assembled by Credit reporting Agencies ''. Due to my personal information being impacted by XXXX Data Breech ( see Attached ) I request documents proving ownership of this debt and authorization to collect this debt. 2nd request for these documents. Ownership of the debt, Flow agreement, Transfer of assignment, Bill of sales. From the first document request I received old statements from XXXX XXXX and a document from Resurgent Capital Services that I never received. The document from Resurgent Capital services, states this account was previously charged off, which means the company received a tax write off to reduce their debt. I never received a XXXX form to claim the charge off as income. " According to IRC 6050P ( c ) ( 2 ), creditors are REQUIRED to issue a form 1099-c, or Cancellation of Debt, when they forgive or cancel a debt of {$600.00} or more owned by a taxpayer ''. I did not approve any other debt collection company to have access to my consumer report information. The original charge off date is XX/XX/XXXX but continues to report being charged off every month, this extends the statute of limitations. According to 15 U.S. Code 1681i " provides consumers with the power to dispute inaccurate information that is listed on their consumer reports ''. This inaccurate information reported on my consumer report is affecting my ability to better my household. If this is not removed or deleted, I will be filling a civil lawsuit against all parties involved, LVNV Funding, Resurgent Capital Services, XXXX, XXXX and XXXX. I recognize all the companies are business partners and work together
