Credit Management Company never contacted me regarding the alleged debt. Within 30 days of me contacting them first, I disputed the debt and requested validation numerous times, including the name and address of the creditor. And I never acknowledged the debt and still don't. This account is in limbo somewhere and they are still keeping me from reviewing and/or resolving with the original creditor if there was one at all. XXXX still never provided this information. Instead, they later claimed to have closed the account and sent it back to the creditor, but still refused to identify the creditor. Under the Fair Debt Collection Practices Act, they are required to identify the creditor upon request and validate the debt. Their refusal is deceptive and unlawful. However all of their negligence and mishandling seems to be on par with their negative reviews. They never even provided me with the name & address of the creditor that itself is a failure to meet their minimum obligation under the FDCPA ( 15 U.S.C. 1692g ). Specifically : > Within 5 days of their first communication with you, a debt collector must send you a written notice that includes : the amount of the debt ; the name of the creditor to whom the debt is currently owed ; a statement that you can dispute the debt within 30 days ; that they will obtain verification of the debt if you dispute it, and the name & address of the original creditor if different. So if they : Failed to send this initial notice, Never identified the creditor in any of their responses to you, they are in clear violation of the FDCPA. And this is not a duplicate complaint.
