In accordance with the Fair Credit Reporting Act ( FCRA ), Discover has violated my consumer rights. Under 15 U.S.C. 1681, Section 602, I have the right to privacy regarding the collection and use of my personal financial data. Additionally, 15 U.S.C. 1681b ( Section 604 ( a ) ( 2 ) ) states that a consumer reporting agency may not furnish a consumer report without the consumers written instructions, unless it is for a legally permissible purpose. I did not authorize Discover to share or report this information under any valid legal basis. Furthermore, under 15 U.S.C. 1666b, a creditor may not treat a payment on an open-end consumer credit account ( such as a credit card ) as late for any purpose unless certain conditions are met. I believe Discover reported a late payment improperly and without meeting those legal conditions. I am requesting a full investigation and immediate removal of the negative information from my credit report if Discover can not provide documentation proving full legal compliance with the above statutes.
