Consumer Narrative
I am filing this formal complaint regarding inaccurate and unverifiable late payment ( s ) being reported on my credit report by XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX as furnished to one or more credit reporting agencies TransUnion ). Despite multiple attempts to resolve this matter directly, the information continues to be reported without legally sufficient validation and in clear violation of the Fair Credit Reporting Act ( FCRA ) and Metro 2 standards. Details of Violation : The alleged late payment ( s ) have been disputed in writing to both the credit bureaus and the original furnisher. Neither party has provided any of the federally required supporting documentation, including : Advance billing statements showing 21-day notice prior to delinquency ( TILA requirement ). Full payment ledgers. Complete Metro 2 coding to validate date of delinquency and payment status. Affirmative proof that the account and alleged late payments are mine and are being reported with accuracy, completeness, and timeliness. This is a direct violation of the following federal laws : 15 U.S.C. 1681i Failure to reasonably investigate a consumer dispute. 15 U.S.C. 1681s-2 ( b ) Furnisher obligations upon notice of dispute. 15 U.S.C. 1666 ( TILA ) Billing and notice requirements. 15 U.S.C. 1681n Willful noncompliance with FCRA, entitling me to statutory damages of {$1000.00} per violation. Additionally, their failure to provide verifiable proof after receiving a written complaint suggests either negligence, data mismanagement, or willful disregard for federal consumer protection laws. The continued reporting of this unverifiable derogatory information has caused harm to my creditworthiness, created barriers to financial opportunities, and exposed me to reputational damage. This complaint is being submitted in good faith, but I will not hesitate to pursue additional remedies in small claims court under 15 U.S.C. 1681n if this issue is not resolved promptly. I am entitled to statutory damages, and I am prepared to file additional complaints with the FTC, State Attorney General, and other appropriate regulatory bodies if necessary.
