I am updating my complaint against Earnest ( serviced by XXXX ). I have received a final response from the XXXX XXXX XXXX XXXX XXXX, stating my in-school deferment was denied despite valid enrollment from XX/XX/XXXX to XX/XX/XXXX, with documentation sent multiple times. Their letter dated XX/XX/XXXX, continues a pattern of misrepresentation, retaliation, and harmful reporting. The denial was based on the false claim that my school doesnt qualify, despite no formal basis for this. This contradicts standard private loan deferment policies. Additionally : They continue to report the account as delinquent, despite active disputes and federal and state complaints. They refused to remove my cosigner, who is medically and cognitively unable to participate in this matter. Their continued demands are predatory. They raised my balance after initiating a complaint, a clear act of retaliation under UDAAP. I have contacted the CFPB, Attorney General of Virginia, and secured legal assistance to resolve this. This is a violation of the Fair Credit Reporting Act ( FCRA ), contract law, consumer protection laws, and FDCPA. This is also emotionally and financially damaging, harming my ability to commute for work, attend required legal and medical obligations, and afford housing stability.
