I am submitting this complaint against Alliant Capital Management, acting on behalf of XXXX XXXX for the debt that originally came from a personal loan with XXXX. Due to financial hardship during COVID period, I defaulted on the loan after losing my at XXXX. At that time, I was contacted by Alliant and was threatened with a potential lawsuit. Out of fear, I felt pressured into signing an electronic payment agreement with them, and have been making bi weekly payments of {$120.00} for over two years ( XXXX XXXXXXXXper month ). The original loan amount was approximately {$18000.00}. I have paid thousands over the last two years, but the balance still shows over {$12000.00}. I have never received a clear breakdown of how my payments have been applied ( towards principal, fees, etc. ) Most recently, I stopped making payments on XX/XX/year> due to financial hardship. Normally I would received follow up calls or emails if a payment is missed, but I have not been contacted since. Additionally any previous payments requests were sent to me as a XXXX XXXX attachment, using my previous last name ( from before I married ) and my former mailing address, despite the fact that I have legally changed my name due to marriage and relocated from XXXX to XXXX updating all public records. So all communications from Alliant Capital Management including payment notices and demands have come addressed to the wrong name and sent to my previous address. The debt is reported on my credit under the original creditor ( XXXX ) as charged off and sold to XXXX. The amount showing is over {$20000.00} which is inconsistent with the amount Alliant claims I still owe, despite having made over two years of payments. Their use of inaccurate information raises serious concerns about the validity of their record, they ability to lawfully collect this debt, and their potential to report incorrect information to the credit bureaus in violation of the Fair Credit Reporting Act and Fair Debt Collection Practices Act. I am formally disputing this debt and requesting a full validation, including the documentation of their right to collect, and proof of my obligation. I am requesting that Alliant Capital Management : 1.Provide full and proper validation of the debt, including proof of assignment, full accounting, and original loan documentation. 2.Pause all collection activity until this debt is properly validated.
