Consumer Narrative

My name is XXXX XXXX XXXX, and I am writing this dispute on my own behalf. I am writing to formally dispute certain information appearing on my Experian credit report that is inaccurate, outdated, and in violation of the Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681 et seq. Specifically, I am disputing : Charge-off accounts that have been fully paid and settled, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Additionally, a collection account that was previously removed after a successful dispute is now improperly reappearing : XXXX XXXX XXXX. Despite these settlements, they are still being reported as derogatory, unpaid, or delinquent. This is inaccurate and misleading and violates the FCRA, which mandates that credit information be complete and up to date. Under FCRA 607 ( b ) [ 15 U.S.C. 1681e ( b ) ], credit reporting agencies must follow reasonable procedures to assure maximum possible accuracy of the information reported. FCRA 611 [ 15 U.S.C. 1681i ], consumers have the right to dispute inaccurate or incomplete information, and CRAs must conduct a reasonable reinvestigation. Since these charge-offs have been satisfied, they should no longer reflect as unpaid or negative. I am requesting immediate correction or removal of these accounts, or an update to accurately reflect the current status as Paid in Full '', Settled or removed completely. This re-reporting of a previously deleted account, without new evidence or notification, is improper and legally questionable. According to : FCRA 611 ( a ) ( 5 ) ( B ), if information is deleted following a dispute, a furnisher may not reinsert it into the credit file unless they certify its accuracy and the credit bureau notifies the consumer in writing within 5 business days. Because I was not notified and no new evidence has been provided, this item must be removed immediately. expect full compliance within the 30-day investigation period as mandated by federal law. If these items are not resolved promptly, I will escalate the matter by filing complaints with the Consumer Financial Protection Bureau ( CFPB ), Federal Trade Commission ( FTC ), and my State Attorney Generals Office. Thank you for your attention to this matter.
