Consumer Narrative

I am filing this complaint against TransUnion for their continued failure to accurately report the status of my accounts in compliance with federal law following my XXXX XXXX Bankruptcy discharge. I filed for XXXX XXXX Bankruptcy under Reference # XXXX in the U.S. Bankruptcy Court and all qualifying debts were discharged under the United States Bankruptcy XXXX XXXX. Despite the legal discharge, TransUnion has failed to update or remove the related accounts and continues to report them with derogatory statuses such as charge-offs, collections, and balances due. This is a direct violation of the Fair Credit Reporting Act ( FCRA ) 15 U.S.C. 1681c ( a ) ( 1 ), which prohibits the reporting of discharged debts as active or derogatory. It also violates FCRA 1681e ( b ), which requires consumer reporting agencies to ensure maximum possible accuracy, and 1681i, which mandates prompt reinvestigation of disputed information. Furthermore, by allowing the continued reporting of these accounts after bankruptcy discharge, TransUnion is contributing to unlawful collection efforts and emotional distress, in violation of the permanent injunction granted under Bankruptcy XXXX XXXX ( a ) ( 2 ), which prohibits any act to collect or recover a discharged debt. I am requesting the Consumer Financial Protection Bureau ( CFPB ) to initiate immediate action and compel TransUnion to conduct a thorough investigation, remove or accurately update all discharged accounts included in my XXXX XXXX Bankruptcy, and ensure my credit report reflects accurate and lawful information.
